The Orihuela Council says that it has doubts about the procedure followed by the builder, who restarted the works in the Alameda del Mar sector, better known as Cala Mosca, on 24 April, on a plot where the construction of 2,200 homes is planned.
A report signed on the same day by the municipal technical services indicates that the developer lacks authorisation from the State Highway Demarcation in the Valencian Community to build the pedestrian walkway over the N-332 highway, which affects the public domain and easement area of the national road.
The technician confirms in the letter that he appeared at the works, according to a request that the developer made on the 21st, although no representative of the company appeared, and that he refused to verify the redefinition of the works.
Sources from the Municipal Council explain that the technical and legal services are studying the procedure, so that if it does not conform to the law, measures will be taken.
The mayoress, Carolina Gracia, has insisted that “in order to legally start the urbanisation works, all the conditions demanded by the technicians must be met”, implying that the start of the works does not have the municipal approval.
She also stated that “we are not going to tolerate impositions or pressures, neither to the municipal council nor to the technicians who issue their reports with diligence and solvency.” She has stressed that “the developer must assume the conditions demanded by the technicians and comply with them”, because “he is a delegate of the administration, not the other way around”.
Cambiemos, who supports the motion of censure, agreeing with the PSOE, that Cala Mosca not be urbanised, has also said that “this is very serious and connects with what we have been saying: the project has numerous irregularities and weaknesses”, according to councillor Carlos Bernabé, who added that “it should not have been approved, but the promoter, with the complicity of PP, C’s and the PSOE of Gracia, does what he wants with the City Council”.
